Drug laws are strict in Canada. These offences are prosecuted under the Controlled Drugs and Substances Act (CDSA). Drug charges often carry mandatory minimum penalties.
Depending on the type of drug and nature of the offence, a conviction can lead to a lengthy term of imprisonment. These charges must be defended vigorously.
The consequences of a conviction for a drug offence is a criminal record that can affect the most important areas of your life:
- Your ability to travel outside of Canada
- Your immigration status (for non-Canadian citizens)
- Your employment prospects
Drug charges can be complex and technical to defend.
If you are charged with a drug offence, your best chance of avoiding life-changing consequences is to obtain proper legal representation.
The lawyers at Friedman Mansour LLP are experienced and knowledgeable in defending drug charges.
If there is a breach of your constitutional rights, we will find it. If there is a defence, we will find it.
We will help you understand your drug charges and analyze all the evidence against you in detail. We will build a powerful defence and push for case dismissal or acquittal at trial.
In drug case, evidence is often based on surveillance, wiretaps, and search warrants.
We have had success in excluding drug evidence from a trial, making it impossible for the prosecution to secure a conviction. In other instances, we have been successful in challenging the validity of a search warrant, identified ways to weaken the prosecution’s case or had the charges stayed or withdrawn on constitutional grounds.
We have also been successful in making constitutional arguments, such as:
- Arbitrary detention
- Right to counsel
- Illegal search and seizure
We will vigorously defend your rights and ensure that you are given the best possible opportunity to avoid a conviction.
The types of drug offences we can help you with include:
- Drug possession
- Drug trafficking
- Drug production
The lawyers at Friedman Mansour LLP will work to minimize the short and long-term effects of these charges on your life.
How we will defend you
We have successfully defended many people charged with drug offences.
We will carefully analyze the evidence against you, look for potential flaws or weaknesses in the Crown’s case and prepare a defence based upon the following:
- Charter rights arguments
- Methods used to search you or your premises
- Surveillance techniques used by law enforcement officers
- Actions taken against you by the police at the roadside or in custody
- The reliability of police informants
If your matter goes to trial, our goal is to obtain an acquittal on all charges. Our lawyers understand how to effectively cross-examine witnesses, including police officers.
What are the classification of drugs?
The CDSA classifies controlled substances into a series of “schedules”. These are large groups of drugs classified according to their chemical properties and effects on the user. The Act states that it is illegal for anyone in Canada to possess substances in Schedule I, II, and III without prior authorization.
The schedules are long and detailed but some of the most common substances listed in each schedule are as follows:
- Schedule I: Cocaine, heroin, morphine, opium, GHB (“date rape” drug)
- Schedule II: Synthetic cannabinoid
- Schedule III: LSD and magic mushrooms
- Schedule IV: Barbiturates (clonazepam, diazepam, amytal, Nembutal)
- Schedule V: Propylhexedrine and any salt derived from it
- Schedule VI: Substances used in the manufacture of other drugs, such as ephedrine, lysergic acid, norephedrine, psedoephedrine.

Fady took very good care of me, keeping my best interest in mind and supported me throughout the process. I am very thankful for his help and would absolutely recommend this office and specifically Mr. Mansour.
Excellent and precise communications skills. Very clear on what my position was, what the legal actions available were, and what his strategy would be to address the situation. And precise execution. He assured me of my rights and position every step of the way. Made me feel totally comfortable with my rights, and let me continue with my life. Highly recommended.
Fady recently represented me in a legal matter during one of the most difficult periods of my life. From the onset, Fady was professional, supportive and reassured me that he would do all he could to ensure a positive outcome, which was achieved. Thank you to Fady and team for your hard work and support!
Solomon is an excellent Lawyer, top in the field of firearms legislation. Would definitely invest time and money for his expertise. Thank you Solomon for first, taking my case and second, supporting a injured veteran.
The night I was charged with assault after a night out drinking was the worst night of my life. As a police officer, an off duty assault conviction would have jeopardized my career. I have worked closely with lawyers my entire nine year career. Either directly with Crown on a case or through cross-examination by defence counsel and after a few minutes of speaking with Solomon shortly after my arrest I knew his knowledge and ability to articulate legal principles were unmatched. He spent nearly an hour on the phone with me gathering facts and providing clear instructions. Throughout the process he kept me updated as to what was going on and I was extremely impressed with his handling of my case. Solomon did his homework on the accusers and witnesses and prepared an unbelievable defence which ultimately led to the charge being dropped on the first day of trial and allowing me to continue my career as a police officer. I’d recommend Solomon to anybody who is in need of expert legal defence.
